Terms and Conditions of Service

Effective version: 2026-10-04-v1

These Terms and Conditions (the “Terms”) govern access to and use of Control de Finanzas, a software service operated by DAVILOZ LLC. By creating an account, purchasing a plan, or continuing to use the Service after accepting these Terms, you enter into a binding agreement with DAVILOZ LLC.

1. Eligibility and account

You must be at least 18 years old and legally capable of entering into a contract. You are responsible for the accuracy of the information you provide, safeguarding your credentials, keeping recovery methods current, and all activity performed through your account. Never provide support personnel with your password, PIN, bank credentials, CVV, one-time authentication codes, or recovery codes.

2. Nature of the Service

Control de Finanzas provides software tools for organization, record keeping, budgeting, planning, reporting, document review, and financial calculations. The Service is not a bank, financial institution, accounting firm, tax preparer, law firm, investment adviser, broker, fiduciary, or credit-reporting service. The Service does not hold, transfer, insure, or guarantee user funds. Outputs, estimates, projections, categories, alerts, and tax-related estimates are informational tools and are not professional advice.

3. User data and financial documents

You control the information you choose to enter or upload. You should not upload information that is unnecessary for the intended function. In particular, avoid full payment-card numbers, CVV codes, online-banking usernames or passwords, authentication codes, Social Security numbers, or other credentials that the Service does not request. You represent that you have the right to process any information you upload.

4. Plans, limits, and feature availability

Features, usage limits, storage behavior, automation, imports, and integrations may vary by plan and configuration. Paid features may be unavailable after a downgrade, cancellation, expiration, or payment failure. Existing data is not deleted solely because a paid subscription ends; the account moves to the applicable Free plan and data remains viewable/exportable where supported, while creation or editing that exceeds Free-plan limits may be restricted.

5. Subscriptions, cancellation, and refunds

You may cancel a paid subscription at any time. Cancellation stops future renewal charges and, when technically available from the payment provider, paid access continues through the end of the already-paid billing period. After that period, the account moves to the Free plan without deleting existing data.

First paid purchase: a full refund may be requested within 9 calendar days after the initial paid purchase. Monthly renewals: after that initial refund window, an already-started monthly renewal is generally non-refundable except for duplicate charges, billing errors, charges after an effective cancellation, or rights required by law. Annual renewals: a refund may be requested within 7 calendar days after the annual renewal charge. No prorated refund is provided for unused time after the applicable window unless required by law. Refund requests must be sent to support@swappzdynamic.com.

6. Payment processing

Payments may be processed by third-party payment providers such as PayPal under their own terms and privacy practices. Control de Finanzas does not require users to provide payment-card security codes or online-banking credentials to use the software.

7. Acceptable use

You may not use the Service to violate law, infringe rights, upload malicious code, bypass access controls or plan limits, interfere with the Service, impersonate another person, process data without authority, conduct fraud, or attempt unauthorized access to accounts, systems, or data.

8. Availability and changes

We work to maintain reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, security events, technical limitations, or changes to supported formats may affect availability. We may modify features when reasonably necessary for security, legal compliance, compatibility, performance, or product development. Material changes to these Terms will be presented with an updated version and, when appropriate, renewed acceptance.

9. User responsibility for financial decisions

You are responsible for reviewing imported transactions, OCR results, classifications, calculations, tax estimates, reconciliations, and reports before relying on them. A successfully parsed file does not establish that the source document is accurate, complete, authentic, or appropriate for tax, accounting, or legal purposes.

10. Intellectual property

The Service, software, interfaces, documentation, and related materials are owned by or licensed to DAVILOZ LLC and are protected by applicable intellectual-property laws. You retain ownership of the data and documents you lawfully provide.

11. Suspension and termination

We may restrict or suspend access when reasonably necessary to protect users or the Service, investigate fraud or abuse, respond to legal requirements, address nonpayment, or enforce these Terms. Subscription cancellation by itself does not delete user data. Account deletion is a separate action and may be subject to legally required retention, security logs, backups, or unresolved payment/dispute obligations.

12. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” DAVILOZ LLC disclaims warranties that are not expressly required by law, including warranties of uninterrupted operation, merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, DAVILOZ LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, or losses caused by decisions made from user-entered or imported data. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Governing law

Except where mandatory law provides otherwise, these Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

14. Contact

Questions, cancellation notices, billing issues, refund requests, and legal notices may be sent to support@swappzdynamic.com.

Privacy Policy

Effective version: 2026-10-04-v1

This Privacy Policy explains how DAVILOZ LLC collects, uses, protects, and discloses information when you use Control de Finanzas.

1. Information we process

Depending on the features you use, we may process account/contact information; business and personal financial records you enter; clients, projects, budgets, bills, goals and notes; uploaded financial files and extracted transaction data; subscription and billing status; support communications; security and technical logs; and records showing the version and date of your Terms and Privacy acceptance.

2. Sensitive financial information

Financial records and uploaded statements are treated as sensitive service data. Do not provide online-banking passwords, PINs, CVV codes, one-time authentication codes, recovery codes, full payment-card details, or Social Security numbers unless a future feature expressly requires them and provides a specific notice. Current bank/document import features do not require those credentials.

3. How we use information

We use information to provide and personalize requested functionality, calculate reports and projections, process imports, maintain account isolation, administer subscriptions, provide support, prevent abuse, secure the Service, diagnose errors, comply with law, and maintain records necessary to operate the Service.

4. Uploaded files and OCR

Financial PDFs and supported import files are processed for the function selected by the user. The current PDF workflow validates file signatures and size limits; supported OCR is performed locally in the user’s browser when available. The original uploaded PDF is not intentionally stored in the WordPress Media Library by the import workflow. Extracted or confirmed transaction data may be stored as part of the user’s financial records.

5. Administrative and support access

Access to personal or financial information is restricted to authorized personnel and only when reasonably necessary to operate, secure, diagnose, support, investigate abuse, comply with law, or respond to an authorized user request. Support personnel should never request your password, bank login credentials, PIN, CVV, one-time authentication code, or recovery code. Infrastructure administrators may have exceptional technical access necessary to operate and secure the system; such access does not authorize use of financial data for unrelated purposes.

6. Payment providers and service providers

Payment transactions may be handled by providers such as PayPal. We may also use hosting, email, security, backup, and infrastructure providers to operate the Service. These providers may process only the information reasonably necessary for their services, subject to their own legal obligations and contracts. We do not sell user financial records for monetary consideration.

7. Separation of accounts and businesses

The Service is designed to separate personal records by user account and business records by user/business context. Users are responsible for selecting the correct account or business when entering or importing information. We use access controls and ownership checks to reduce unauthorized cross-account access.

8. Retention

We retain information while an account is active and as reasonably necessary to provide the Service, maintain security/audit records, resolve disputes, enforce agreements, comply with law, and maintain backups. Cancelling a paid subscription does not delete data: the account moves to the applicable Free plan. You may contact us to request account deletion; some information may remain temporarily in backups or be retained when required for legal, security, fraud-prevention, billing, or dispute purposes.

9. Security

We use administrative, technical, and access-control measures intended to protect information. No Internet-connected system can guarantee absolute security. You are responsible for using a strong unique password, protecting your devices, and enabling additional authentication controls when available.

10. Your choices and requests

You may update information through available account tools, export supported records, cancel subscriptions, and contact us to request access, correction, deletion, or other privacy assistance. Rights vary by jurisdiction and may be subject to verification and legal exceptions.

11. Age restriction

The Service is intended only for persons 18 years of age or older and is not designed for children.

12. Legal disclosures

We may preserve or disclose information when reasonably necessary to comply with law, valid legal process, protect rights and safety, investigate fraud/security incidents, or enforce agreements. We may also disclose information in connection with a merger, financing, acquisition, reorganization, or transfer of business assets, subject to applicable law.

13. Changes

We may update this Policy. Material changes will use a new version and, when appropriate, will require renewed acceptance.
